1. Overview

ArcwellStack is an AI voice generation platform for creators, developers, and enterprises. These Terms of Service apply to the ArcwellStack website, application, dashboards, APIs, SDKs, and related services (the "Services"). By accessing or using the Services, you agree to these Terms.

2. Eligibility and Account

  • You must be legally able to form a binding contract and have permission to use the Services on behalf of your organization, if applicable.
  • You must provide accurate account information and keep it up to date.
  • You are responsible for all activity that occurs under your account and for keeping your credentials secure.

3. Acceptable Use and Safety

You agree to use the Services in compliance with applicable laws and our safety requirements. You must not:

  • Create or distribute deceptive, fraudulent, or harmful content.
  • Impersonate individuals without explicit permission.
  • Upload content that violates intellectual property, privacy, or publicity rights.
  • Attempt to bypass safety, security, or usage limits.
  • Use the Services to generate content intended to cause harm, harassment, or discrimination.

If you use voice cloning or similar features, you must obtain and keep clear consent from the voice owner or use your own voice. You are responsible for complying with all consent and disclosure obligations in your jurisdiction.

5. Your Content and Output

  • Your content: You retain ownership of the text, audio, or other content you submit to the Services ("Input").
  • Generated output: You own the audio or other outputs created from your Input ("Output"), subject to these Terms.
  • License to operate: You grant ArcwellStack a limited, non-exclusive, worldwide license to host, process, and transmit Input and Output solely to provide, maintain, and secure the Services.

6. Model Improvement

We may use aggregated or de-identified usage data to improve the Services. If we offer optional programs that use customer content to improve AI models, we will request explicit permission and provide clear controls.

7. Plans, Billing, and Refunds

  • Pricing and feature tiers are described on the Pricing page.
  • Subscriptions may renew automatically unless canceled.
  • Usage-based features may incur additional charges.
  • Refunds are provided only where required by law or expressly stated in your plan.

8. API and Developer Use

If you access the ArcwellStack API, you must safeguard API keys, follow documentation guidelines, and respect rate limits. You may not reverse engineer or misuse the Services or access them in a way that could disrupt other users.

9. Third-Party Services

We may use third-party service providers for hosting, analytics, payments, or customer support. Your use of those services may be subject to their terms.

10. Suspension and Termination

We may suspend or terminate access if you violate these Terms or create risk for other users or ArcwellStack. You can cancel your account at any time. We may retain data as required by law or for legitimate business purposes.

11. Disclaimers

The Services are provided "as is" and "as available." We disclaim all warranties to the fullest extent permitted by law.

12. Limitation of Liability

To the fullest extent permitted by law, ArcwellStack will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill.

13. Indemnification

You agree to indemnify and hold harmless ArcwellStack and its affiliates from claims, liabilities, damages, and expenses arising from your use of the Services, your content, or your violation of these Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction where ArcwellStack is established, without regard to conflict of law rules. Disputes will be resolved according to applicable law and any agreed dispute resolution procedures.

15. Changes to These Terms

We may update these Terms from time to time. Changes become effective when posted, and continued use of the Services indicates acceptance of the updated Terms.
